1. Acceptance of these terms
These Terms of Use (the "Terms") are a binding agreement between you and HistorySim3D, LLC ("HistorySim3D", "we", "us"), which operates historysim3d.com and the Sims, games and community features available through it (together, the "Service"). By visiting the site, buying a pass, creating an account, or submitting content, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of an organisation, you confirm that you have authority to bind it, and "you" includes that organisation.
2. What the Service is
HistorySim3D publishes interactive three-dimensional digital reconstructions of places, machines and events ("Sims"), browser-based games set inside those reconstructions ("Games"), and Sims and Games submitted by members of the community ("Community Content"). Some Sims offer a free 30-second glimpse; full access to Sims and Games requires an active pass. We may add, change, suspend or retire any Sim, Game or feature at any time.
3. Accounts and eligibility
You must be at least 13 years old to create an account or buy a pass, and if you are under 18 you must have a parent or guardian’s permission. A Day Pass may be bought without an account and is tied to the browser it was bought in. Longer passes and community submissions require an account. You are responsible for keeping your login details confidential and for everything that happens under your account. Tell us at info@historysim3d.com immediately if you believe your account has been compromised.
4. Passes, billing and renewal
Current pass prices are shown on the Passes & pricing page and at checkout, in US dollars, exclusive of any applicable sales tax, which is calculated at checkout. Payments are processed by Stripe, Inc.; we do not store your full card details.
| Pass | Price | Term | Renewal |
|---|---|---|---|
| Day Pass | $10 | 24 hours from purchase | Does not renew |
| Quarter Pass | $25 | 3 months | One-time — does not renew |
| Year Pass | $60 | 12 months | One-time — does not renew |
Passes are personal to you. Sharing login details, reselling passes or using automated tools to access content is a breach of these Terms.
5. Refunds
Day Pass. Because a Day Pass gives immediate access to everything for 24 hours, it is non-refundable once activated, except where required by law or where the Service was unavailable for a substantial part of the 24 hours through our fault — in which case we will refund or extend it.
Quarter and Year Passes. You may request a full refund within 14 days of purchase if you have not yet used the pass to open a locked Sim or Game. After that, refunds are at our discretion and normally prorated only where we have withdrawn a material part of the Service. To request a refund email info@historysim3d.com with your order number.
Nothing in this section limits statutory rights you may have as a consumer in your country or state.
6. Our content and your licence to use it
The Sims, Games, models, text, images, video, code, design, and the HistorySim3D name and logo are owned by HistorySim3D or its licensors and are protected by copyright, trademark and other laws. Historical facts themselves are not owned by anyone; our expression of them — the geometry we built, the way it is presented — is.
Subject to these Terms we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to view and interact with the Service for personal, educational and non-commercial purposes. Year Pass holders may additionally download the source packs, drawings and 3D model files we make available, for personal, academic and editorial use with attribution to "HistorySim3D" and the sources cited on the Sim's page. Commercial use, broadcast, courtroom exhibits and redistribution require a separate written licence — contact us.
You may not copy, scrape, reverse-engineer, frame, mirror or bulk-download the Service or its content, remove notices or watermarks, or use our content to train machine-learning models, except as expressly allowed above or by law.
7. Community submissions
Members with an active pass may submit Sims and Games for publication. A submission must be a single .zip archive containing an index.html at its top level, all files needed to run it, a source list, and a preview image, as described on the Community page. We review every submission against the Content standards below before publishing and may decline, edit metadata for, or later remove any submission at our discretion. Review does not mean we have verified the content's accuracy or its licensing, which remain the creator's responsibility.
8. Creator licence and warranties
You keep your copyright. Submitting content to HistorySim3D does not transfer ownership to us.
Licence to us. By submitting content you grant HistorySim3D a worldwide, non-exclusive, royalty-free, sublicensable (to our hosting and service providers only) licence to host, store, reproduce, adapt for technical compatibility (for example re-encoding or resizing), display, perform, stream and distribute the content through the Service, and to use its title, preview image and short excerpts to promote the Service and your content, in any medium. This licence lasts for as long as the content is on the Service plus a reasonable period to remove it from caches and backups, and survives for content that others have already downloaded or embedded under these Terms.
Your name. Your content is published under the creator name on your account. You may ask us to change it or to remove your content at any time; we will act within 14 days, subject to the survival period above.
Warranties. You represent and warrant that: (a) you created the content or otherwise hold every right needed to grant the licence above; (b) the content and every model, texture, image, sound, font, script and data file in it is either your own work, in the public domain, or used under a licence that permits publication on a commercial website, and any required attribution is included in your source list; (c) the content does not infringe any copyright, trademark, privacy, publicity or other right of any person; (d) it complies with the Content standards; and (e) the source list you supply is accurate. Content built from Google Maps or Earth imagery, from photographs or footage you do not have a licence to reproduce, or from "non-commercial" licensed assets does not meet these warranties.
Attribution and moral rights. To the extent permitted by law you waive any moral rights that would prevent us exercising the licence above; we will always credit you as creator unless you ask us not to.
9. Content standards
All content on the Service, ours and yours, must:
- stick to the documented record for events involving real people, and clearly label anything that is inferred, estimated or dramatised;
- avoid gratuitous depictions of injury, death or suffering — the purpose is understanding, not spectacle;
- not defame, harass or threaten any person, and not use a real person's name, image or likeness to suggest they endorse the content;
- not contain malware, trackers, hidden network calls, cryptocurrency mining, or code that alters other parts of the Service;
- not contain sexually explicit material, incitement to violence, or content that is unlawful where we operate;
- carry an accurate source list.
Our full standards and sourcing rules are on the Sources & content standards page.
10. Copyright complaints and takedown
We respect the intellectual property of others and expect the same from our users. If you believe content on the Service infringes your copyright, follow the notice procedure on our Copyright & DMCA page. We will remove or disable access to content that is the subject of a valid notice, notify the creator, accept counter-notices, and terminate the accounts of repeat infringers in accordance with the Digital Millennium Copyright Act (17 U.S.C. §512).
11. Acceptable use
You agree not to: interfere with or overload the Service; bypass access controls, the 30-second glimpse limit or member gates; scrape or harvest content or personal data; misrepresent your identity or affiliation; submit content you do not have rights to; use the Service to harass anyone; or use it for any unlawful purpose. We may investigate and take any action we consider appropriate, including removing content and suspending accounts.
12. Historical accuracy and no professional advice
Sims are reconstructions built from the sources cited on each Sim's page. They are our best effort to represent the record faithfully, but any reconstruction involves interpretation, and sources can be incomplete or wrong. The Service is provided for education and general interest. It is not engineering, legal, forensic, safety or investigative advice, and must not be relied on for any decision of that kind. Where a Sim depicts a real event we make no claim about the intent, guilt or innocence of any person beyond what the cited public record states.
13. Disclaimers and limitation of liability
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR THAT ANY CONTENT IS ACCURATE OR COMPLETE. COMMUNITY CONTENT IS THE RESPONSIBILITY OF THE PERSON WHO SUBMITTED IT.
TO THE FULLEST EXTENT PERMITTED BY LAW, HISTORYSIM3D AND ITS OWNERS, OFFICERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AND (B) US $50. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU IN FULL.
14. Indemnity
You will defend, indemnify and hold harmless HistorySim3D and its owners, officers, employees and contractors from any claim, loss, liability and expense (including reasonable legal fees) arising out of content you submit, your breach of these Terms, or your violation of any law or any third party's rights. We may take over the defence of any matter subject to indemnity, in which case you will cooperate with us.
15. Termination
You may close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or if we discontinue the Service. On termination your licence to use the Service ends; sections 6, 8, 13, 14 and 16 survive. If we terminate a paid pass without cause we will refund the unused portion on a prorated basis.
16. Governing law and disputes
These Terms are governed by the laws of the State of Texas and the federal laws of the United States, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at info@historysim3d.com and to try in good faith to resolve the dispute informally for at least 30 days. Any claim that cannot be resolved informally will be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction, except that either party may bring a claim in small-claims court or seek injunctive relief for infringement of intellectual property anywhere.
17. Changes to these Terms
We may update these Terms from time to time. We will post the new version here with a new effective date and, for material changes, notify account holders by email at least 14 days before they take effect. Continued use after the effective date means you accept the changes. Changes do not apply retroactively to disputes that arose before them.
