1. Overview
HistorySim3D hosts reconstructions we build ourselves and Sims and Games submitted by community members. We respect copyright and comply with the Digital Millennium Copyright Act, 17 U.S.C. §512. If you are a copyright owner, or authorised to act for one, and believe that content on historysim3d.com infringes your copyright, you can ask us to remove it using the notice procedure below. If your content was removed and you believe that was a mistake, you can file a counter-notice. This page also sets out our sourcing and content standards and the open-source credits for the software the site runs on.
2. Filing a copyright infringement notice
Send a written notice to our designated agent (section 5) by email or post containing all of the following:
- identification of the copyrighted work you claim has been infringed (or a representative list if there are several);
- identification of the material you claim is infringing and enough information for us to locate it — the URL of the Sim or Game page is ideal, plus the file or element within it if the Sim as a whole is not at issue;
- your name, mailing address, telephone number and email address;
- a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law;
- a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf;
- your physical or electronic signature.
What happens next. On receipt of a complete notice we will promptly remove or disable access to the material, notify the member who submitted it (if it is community content) and provide them with a copy of your notice, and record the notice. Incomplete notices may be returned for completion. We act within 5 business days.
3. Counter-notice
If material you submitted was removed and you believe it was removed by mistake or misidentification — for example because you own it, hold a licence, or the use is fair — you may send a counter-notice to our designated agent containing:
- identification of the material that was removed and the URL where it appeared before removal;
- your name, address, telephone number and email address;
- a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
- a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which HistorySim3D may be found), and that you will accept service of process from the person who filed the original notice or their agent;
- your physical or electronic signature.
We will forward the counter-notice to the person who filed the original notice. If they do not tell us within 10 business days that they have filed a court action to restrain the alleged infringement, we may restore the material between 10 and 14 business days after receiving your counter-notice.
4. Repeat infringers
We keep a record of notices against each account. An account that repeatedly receives valid notices that are not successfully countered, or that we determine has uploaded infringing content deliberately, will be terminated and any active pass forfeited. We may also terminate at the first offence for flagrant infringement, such as uploading someone else's entire model or film.
5. Designated copyright agent
All communications — copyright notices, corrections and any other questions — go to info@historysim3d.com.
6. Trademarks, privacy and likeness complaints
Sims may name the companies, products, places and people they depict in order to describe them; this is nominative use, and we do not use third-party logos or imply endorsement. If you believe a Sim or Game misuses your trademark, or uses your name, image or likeness in a way that violates your privacy or publicity rights, or contains false statements about you, email info@historysim3d.com with the URL, the specific element at issue and the basis of your complaint. These complaints are not DMCA notices, but we review them promptly and will remove or amend content where a complaint is well-founded. We also welcome corrections to the historical record — see the standards below.
7. Sources & content standards
These standards apply to every Sim and Game on the Service, whether built by us or by the community. They exist so that a reconstruction can be trusted, so that it respects the people it depicts, and so that it does not infringe anyone's rights.
Sourcing
- Every Sim ships with a source list naming the plans, surveys, photographs, footage, official reports, records and datasets it was built from. "Built from" means measured, traced or derived — not reproduced.
- Prefer public-domain and government sources: USGS and state LiDAR, NOAA, NASA, NTSB, FAA, congressional and court records, historic engineering drawings held by public archives, and your own site surveys.
- Copyrighted photographs, film and drawings may be used as reference for geometry and colour. They may not appear in the Sim itself — as textures, billboards, cut-scenes or overlays — without a written licence, which must be listed in the source list.
- Third-party 3D assets, textures, sounds and fonts must be your own, public domain, or under a licence that allows use on a commercial website (CC0, CC-BY with attribution, MIT, OFL, and similar). "Non-commercial" and "no-derivatives" licences are not acceptable. Attribution required by a licence goes in the source list and, where the licence demands it, on screen.
- Imagery from Google Maps, Google Earth, Apple Maps and similar services may not be used to build or texture models; their terms forbid it. OpenStreetMap data is acceptable with ODbL attribution.
- Where the record is incomplete, say so. Mark inferred or estimated elements in the Sim or its notes.
Real people and real events
- Stick to the documented public record — official reports, court findings, contemporaneous journalism. Do not present a contested theory as fact. Do not assert motive, guilt or innocence beyond what the record states.
- Depict what is needed to understand the event. No gratuitous or lingering depictions of injury, death or suffering; no gore; no recreation of a victim's final moments beyond what the official timeline requires.
- Do not use a real person's name, face or likeness in titles, thumbnails or marketing in a way that suggests endorsement, and do not use victims' images at all.
- Living people and the recently deceased have privacy and publicity rights that vary by state. When in doubt, depict the place and the timeline rather than the person.
- Events with an ongoing investigation or trial may be held until the record is settled.
Technical
- Sims and Games must run in a modern browser from an
index.html, self-contained, using relative paths, with no hidden network calls, trackers, cryptocurrency mining or code that reaches outside the Sim. - Keep packages under 500 MB and textures at or below 4K.
Corrections
If you believe a Sim is inaccurate, tell us at info@historysim3d.com with the source that supports the correction. Verified corrections are applied and noted in the Sim's version history.
